Couple say new car had serious flaws

KINGWOOD — A married couple's lawsuit against Victory Automotive Group LLC, FCA US LLC and Chrysler Capital Group LLC, car dealer, manufacturer and financier, alleges fraud and negligence.

William Means and Trina Means filed a complaint on Aug. 8 in Preston Circuit Court against the defendants, alleging that they violated the West Virginia New Motor Vehicle Warranty Act.

According to the complaint, the plaintiffs allege that on July 27, 2015, they purchased a new 2015 Dodge Charger CP. Shortly after purchase, they experienced problems with the quality of workmanship of the defective vehicle, causing it to run roughly, lose power and be unsafe to operate, which were likely to cause serious injuries and even death, they allege. They suffered loss of use of the vehicle, diminution in value, annoyance, aggravation and inconvenience, they claim. The plaintiffs hold the defendants responsible because the defendants allegedly manufactured the vehicle defectively and failed to repair all defects within the reasonable time and in a workmanlike manner.

The plaintiffs request a trial by jury and seek judgment against the defendants for revocation of the acceptance of the vehicle, refunds of payment made, including other fees and expenses, attorneys' fees, pre- and post-judgment interest and all other relief as the court deems necessary. They are represented by Mark E. Gaydos, Buddy Turner and Hilary M. Bright of McNeer, Highland, McMunn and Varner LC in Kingwood.
