HD Media Company LLC is doing business as The Herald-Dispatch.
Ronald David Farley was a truck driver for The Herald-Dispatch and, as part of his job duties, he was required to transport rolls of printing paper on the defendant’s 1997 International flatbed truck from the warehouse to its printing facility and unload the paper rolls onto a freight elevator, according to a complaint filed Aug. 8 in Cabell Circuit Court.
Lora Rose Farley claims the unloading process required Ronald Farley to park the truck and perform the delivery and unloading process alone and unsupervised.
On Dec. 15, 2014, while engaged in his job duties alone, he was in the process of unloading six rolls of printing paper and was starting to loosen the ratchet straps when the truck started to roll down the company owned alley, according to the suit.
The force of the roll caused Ronald Farley to lose his balance and fall off the truck between the truck and the alley wall, according to the suit.
Lora Farley claims Ronald Farley was pinned between the truck and the wall of the building and his internal organs and the bones in his body were crushed.
Ronald Farley was hospitalized in severe and agonizing pain until he succumbed to his crushing injuries on Dec. 22, 2014, according to the suit.
Lora Farley claims the defendant was liable for her husband’s damages; pain and suffering; medical expenses; and funeral expenses.
Lora Farley is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Brett J. Preston and Dan R. Snuffer of Preston & Salango PLLC.
The case is assigned to Circuit Judge Christopher D. Chiles.
