WINFIELD — A sealant manufacturer is suing Egreen of Dayton LLC, a contractor, citing alleged breach of contract.
Plastic Coatings Corporation filed a complaint on Aug. 8 in Putnam Circuit Court against Egreen of Dayton LLC, alleging that the contractor failed to comply with the terms of a credit application.
According to the complaint, the plaintiff alleges that it has sold Jaxsan coating product tothe defendant for the defendant's application on a roof of a commercial property. The defendant allegedly finished its application in the latter part of October 2015. To date, the plaintiff has not received payment for all the sealants sold to the defendant in the amount of $21,000 plus contractual interest of $3,467.08, the suit alleges. The plaintiff holds Egreen of Dayton LLC responsible because the defendant allegedly failed to pay for all the sealant sold by the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $21,000, plus $3,467.08 in contractual interest, collection fees, pre- and post-judgment interest, attorney fees, costs and such other relief as the court deems just.
