Homeowner blames damage on explosions

LOGAN — A homeowner is suing Bizzack Construction LLC, a highway construction firm, alleging insufficient measures were taken to prevent damage.

Brandon Vance filed a complaint on Aug. 10 in Logan Circuit Court against Bizzack Construction LLC, alleging that the highway construction firm failed to exercise reasonable care to protect other properties.

According to the complaint, the plaintiff alleges that between September 2013 and June 2016, the defendant set of a series of explosions on a highway construction project adjacent to his property near McConnel. As a result of the series of explosions, his real and personal property was damaged and lost value, he alleges, adding that he also suffered annoyance and inconvenience. The plaintiff holds Bizzack Construction LLC responsible because the defendant allegedly negligently set off explosives near his property.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages and such other and further relief as the court deems just and proper. He is represented by Robert K. Kuenzel of Kuenzel and Associates PLLC in Chapmanville.
