Borrower blames bank for erratic loan handling

MOUNDSVILLE — A borrower is suing Wells Fargo Bank NA, alleging breach of contract and bad faith.

Devin R. Whipp filed a complaint on Aug. 15 in Marshall Circuit Court against Wells Fargo Bank NA, alleging that the bank violated the Consumer Credit Protection Act.

According to the complaint, the plaintiff alleges that, between 2006 and 2008, he obtained three private student loans from Lehman Brothers Bank, which was later acquired by defendant. Whipp claims he has had difficulty making payments in the correct amount and on time because of Wells Fargo's erratic billing and failure to provide a coupon book, causing him to incur additional interest and fees and suffer annoyance, aggravation, inconvenience and emotional distress. The plaintiff holds Wells Fargo responsible because the defendant allegedly randomly sent monthly billing statements, failed to provide him with a coupon book to make loan payments and failed to provide a receipt for his payments.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, plus penalties, attorneys' fees, pre- and post-judgment interest and any other relief the court deems just and proper.
