Two parties accuse energy company of unlawful deduction

Law money 04

MOUNDSVILLE — Two parties are suing Chevron USA Inc., an energy company, citing alleged unlawful deduction.

John Robert Bonar and John & Werner Law Offices PLLC filed a complaint on Aug. 15 in Marshall Circuit Court against Chevron USA Inc., alleging that the energy company violated their contractual agreement.

According to the complaint, the plaintiffs allege that in March, the defendant began deducting certain costs from the plaintiffs' royalty payments, causing them to sustain monetary losses. The plaintiffs holds Chevron USA Inc. responsible because the defendant allegedly has neither the authority or the right to deduct costs from the plaintiffs' respective royalties and wrongfully deducted and withheld as costs approximately $1,961 from plaintiff Bonar and approximately $305 from plaintiff John & Werner.

The plaintiffs request a trial by jury and seek an order that defendant has no right to deduct costs from the plaintiffs' respective royalties, an order prohibiting the defendant from imposing costs deductions, an order for the defendant to pay the respective monies and for any further relief within the direction of the court. They are represented by Anthony I. Werner and Joseph J. John of John & Werner Law Offices PLLC in Wheeling.
