Widow says nursing home responsible for death

WINFIELD — A widow is suing 590 North Poplar Fork Road Operations LLC d/b/a Teays Valley Center and Genesis Healthcare LLC in a wrongful death claim alleging negligence in nursing home care.

Lucille Winter, as personal representative of the estate of James W. Winter Sr., deceased, filed a complaint Aug. 15 in Putnam Circuit Court against the defendants, alleging that they failed to provide an environment to prevent accidents.

According to the complaint, the plaintiff alleges that between March 14, 2014 and June 15, 2015, James Winter Sr. was a resident at the defendants' nursing facility Teays Valley Center. During his residency, he suffered multiple accidental falls, abuse, neglect, physical pain, mental anguish and medical expenses, the suit alleges. His suffering from systematic abuse and neglect contributed to his death Aug. 15, 2015, the suit claims. The plaintiff holds the defendants responsible because they allegedly failed to provide adequate supervision and assistance devices to prevent accidents and failed to provide an appropriate resident care plan.

The plaintiff requests a trial by jury and seeks judgment against the defendants for all damages, attorney's fees, costs and all other items that the court sees fit. She is represented by Andrew L. Paternostro of The Bell Law Firm PLLC in Charleston.
