WHEELING — A motorist is suing Anthony E. DeMarco, Giant Eagle Inc., Talon Logistics Inc., Farm Credit Leasing Services and John Doe, alleging negligence that led to his injuries in a vehicle collision.
Frank L. Davis filed a complaint on Aug. 15 in Ohio Circuit Court against the defendants, alleging that DeMarco breached his duty of due care to operate a tractor-trailer with reasonable diligence.
According to the complaint, the plaintiff alleges that on Aug. 28, 2014, he was operating his 1994 Buick, traveling from his home to his employment in Washington County, Pennsylvania, when his vehicle was violently rear-ended by a tractor-trailer owned, operated, maintined or controlled by the defendants, causing him to sustain injuries to his body and damages to his vehicle. He also suffered physical pain, mental anguish, annoyance, inconvenience and other damages, he claims. The plaintiff holds the defendants responsible because DeMarco allegedly failed to keep proper lookout, failed to operate the vehicle in a safe manner and failed to take reasonable measures to avoid the accident.
The plaintiff requests a trial by jury and seeks judgment against the defendants jointly and severally, in an amount which will adequately compensate his damages, plus interest, costs and attorney's fees incurred for this action.
