BECKLEY — A patient is suing Jose Jorge Gordinho d/b/a Responsible Pain & Aesthetic Mgmt PLLC, a medical service provider, citing alleged gross negligence and intentional infliction of emotional distress.
Danielle Mathis filed a complaint on Aug. 19 in Raleigh Circuit Court against the defendant, alleging that he violated the West Virginia Human Rights Act.
According to the complaint, the plaintiff alleges that she was subjected to inappropriate touching and a continuing pattern of sexual harassment. She was caused to suffer pain and suffering, medical expenses, humiliation, annoyance, inconvenience and emotional distress. The plaintiff holds Jose Jorge Gordinho d/b/a Responsible Pain & Aesthetic Mgmt PLLC responsible because the defendant allegedly fondled her breast while pretending to hear her heart beat and taking her pulse by pinching the nipple and areola areas of her breast, wrongfully called his staff members to look at her inverted nipples and continued to sexually harassed her by putting his arms around her waist unsolicited.
The plaintiff requests a trial by jury and seeks compensation for damages in an amount to fully compensate her, plus legal expenses, and any other damages to which she may be entitled. She is represented by David A. Kirkpatrick of Kirkpatrick Law Office PLLC in Beckley.
