Woman alleges disability discrimination by Wheeling Hospital

WHEELING — A dietary worker is suing Wheeling Hospital Inc., alleging disability discrimination.

Diane Russell filed a complaint on Aug. 19 in Ohio Circuit Court against Wheeling Hospital Inc., alleging that the health care facility operator violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that in April 2014, as a result of her depression-based disability due to her husband's death, she required clinical and medical health care treatment and was off for work for several months. When she was scheduled to return to work, she was terminated from her employment, causing her to suffer economic losses, humiliation, embarrassment and emotional distress, she alleges. The plaintiff holds Wheeling Hospital Inc. responsible because the defendant allegedly failed to provide reasonable accommodations and terminated her employment based upon her depression-based disability.

The plaintiff requests a trial by jury and seeks judgment against the defendant in a just amount as determined by a jury, plus pre- and post-judgment interest, costs, attorney's fees and other relief that the court deems appropriate.
