Woman claims trucker caused collision, injuries

MOOREFIELD — A motorist is suing Mountain State Concrete LLC, David Adams LLC and William W. Wehland, truck driver and employers, alleging insufficient measures were taken to prevent injuries.

Sandra Derr filed a complaint on Aug. 22 in Hardy Circuit Court against the defendants, alleging that Mountain State Concrete LLC and/or David Adams LLC negligently entrusted a cement truck to defendant Wehland.

According to the complaint, the plaintiff alleges that on Sept. 8, 2014, she was operating a motor vehicle on a public highway in Hardy County while Wehland, who was operating a cement truck owned by Mountain State Concrete LLC and/or David Adams LLC, caused a collision with her vehicle. Derr alleges the crash caused injuries, pain and suffering, emotional distress and expenses in excess of $59,000. The plaintiff holds the defendants responsible because Wehland allegedly carelessly operated the cement truck.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages in excess of the jurisdictional limits of the court, attorney's fees and costs and such other relief as the court deems proper.
