BECKLEY — An equipment lessor is suing A&G Coal Corporation, a mining company, citing alleged breach of contract.
Deere Credit Inc. filed a complaint on Aug. 23 in Raleigh Circuit Court against A&G Coal Corporation, alleging that the mining company breached a lease agreement.
According to the complaint, the plaintiff alleges that it suffered damages for paying repair expenses for damaged leased equipment in the amount of $218,220.57, plus legal interest amounting to $21,301.91 and attorneys' fees in the amount of $72,740.19. The plaintiff holds A&G Coal Corporation responsible because the defendant allegedly willfully failed and refused to pay the balance, interest and any part thereof.
The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $312,262.67, plus continuing interest of 7 percent per annum from Feb. 27, 2015 and costs of the action. It is represented by Arch W. Riley Jr. of Bernstein-Burkley PC in Wheeling.
