Man claims termination was violation of public policy

NEW CUMBERLAND — A former employee is suing his former employer and its officers, citing alleged intentional infliction of emotional distress and wrongful termination.

Michael Dalrymple filed a complaint on Aug. 19 in Hancock Circuit Court against Bellofram Corporation, Joseph J. Colletti, Jr. and Sharon Coleman, alleging that they violated West Virginia public policy.

According to the complaint, the plaintiff alleges that, in 2013, he was approved for intermittent Family and Medical Leave Act leave for occasional headaches and sinus infection. In September 2015, the defendants sent him for an examination by a Dr. Isla. On May 2, Isla advised the defendants that the plaintiff did not suffer from any nasal disorders, the suit says, adding that the defendants then fired him to avoid any future problems connected to an alleged sensitivity to chemicals in the workplace.

Dalrymple alleges that the defendants' actions caused him to suffer lost wages and benefits, mental distress, humiliation and inconvenience. The plaintiff holds the defendants responsible for allegedly committing a tort of outrage/intentional infliction of emotional distress.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages in an amount to be proven at trial, attorneys' fees, costs and other losses. He is represented by Frank H. Duff and Sandra K. Law of Schrader Byrd & Companion PLLC in Wheeling.
