NEW MARTINSVILLE — A natural gas processing plant is suing J.F. Allen Company, Amec Foster Wheeler Environment & Infrastructure Inc., et. al., contractor and subcontractors, citing alleged breach of contract and gross negligence.
Markwest Liberty Midstream & Resources LLC filed a complaint on Aug. 19 in Wetzel Circuit Court against the defendants, alleging that they failed to comply with the applicable standard of care for the construction industry.
According to the complaint, the plaintiff alleges that on Sept. 5, 2014, it entered into a contract with defendant J.F. Allen for the design and construction of a retaining wall to create the flat land necessary to build the Mobley V Processing Plant. As a result of the defendants' failure to complete the work, the plaintiff incurred millions of dollars in change orders, the suit alleges. The plaintiff holds the defendants responsible for allegedly negligently designing and failing to properly construct the retaining wall and for allegedly failing to timely perform the work as agreed under the contract.
The plaintiff requests a trial by jury and seeks judgment against the defendants for all damages allowed by law, plus interest, costs, expenses and other relief as the court deems appropriate.
