HUNTINGTON — A married couple's lawsuit accuses a hospital of being responsible for a slip and fall.
The pair are suing Cabell Huntington Hospital Inc., alleging failure to warn, negligence and insufficient measures taken to prevent injuries.
Judy Nelson and Earl Nelson filed a complaint on Aug. 9 in Cabell Circuit Court against the hospital company, alleging that the defendant breached its duty to provide the public with a safe environment.
According to the complaint, the plaintiffs allege that on Aug.4, 2014, shortly after exiting the elevator, Judy Nelson suffered injuries when she slipped and fell on a freshly mopped floor in the defendant's facility, suffering injuries that required medical treatment. The plaintiffs holds Cabell Huntington Hospital Inc. responsible because the defendant allegedly failed to properly maintain its premises, failed to warn the public of the unsafe and dangerous condition and failed to properly train and supervise its employees.
The plaintiffs request a trial by jury and seek compensation for their injuries and damages, plus interest, costs of court, pre- and post-judgment interest and other relief. They are represented by Richard E. Holtzapfel of Holtzapfel Law Offices PLLC in Hurricane.
