Man accuses Marshall Health, Drug Emporium of invasion of privacy

HUNTINGTON — A man is suing his former employer and former health care provider, alleging invasion of privacy and negligent infliction of emotional distress.

Leonard Childres is suing former health care provider University Physicians and Surgeons Inc. d/b/a Marshall Health and former employer Discount Emporium Inc. d/b/a Drug Emporium. He filed a complaint Aug. 10 in  Cabell Circuit Court against the defendants, alleging that they violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that on in Aug. 14, 2015, he was terminated from his employment with Drug Emporium after 27 years of service, causing him to suffer permanent and irreparable harm. On Aug. 17, 2015, he was informed that he was no longer allowed to receive treatment at Marshall Health, he alleges. The plaintiff holds the defendants responsible because Marshall Health employees allegedly improperly accessed his medical records and then disseminated and disclosed his medical information regarding depression and mental health without his permission to his employer, Drug Emporium.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, plus interest, attorneys' fees, pre- and post-judgment interest and other relief. He is represented by James D. McQueen and Anthony E. Nortz of McQueen Davis PLLC in Huntington.
