HUNTINGTON — A patient is suing Cabell Huntington Hospital, alleging unfair and unconscionable collection practices.
Karen D. King filed a complaint Aug. 11 in Cabell Circuit Court against Cabell Huntington Hospital alleging that the hospital operator violated the West Virginia Consumer Credit and Protection Act.
According to the complaint, the plaintiff alleges that on Feb. 26, 2015, the defendant brought a debt collection lawsuit against her, causing her to suffer damages including annoyance, inconvenience, aggravation, emotional distress and embarrassment. The plaintiff holds Cabell Huntington Hospital responsible because although the hospital allegedly received full payment of the debt, it purportedly requested that a summons be issued for the plaintiff and failed to take any steps to make sure that the complaint against her was dismissed.
The plaintiff requests a trial by jury and seeks compensation for actual damages, punitive damages and an order to deter the defendant from engaging in unlawful collection practices.
