Customer accuses Chase Bank of invasion of privacy in attempt to collect debt

FAYETTEVILLE — A West Virginia woman is suing Chase Bank, alleging intentional infliction of emotional distress and invasion of privacy.

Virginia K. Wardrup filed a lawsuit Aug. 31 in Fayette Circuit Court against Chase Bank USA, National Association, alleging violation of the West Virginia Consumer Credit and Protection Act.

According to the complaint, on June 14, Wardrup began receiving telephone calls from Chase, attempting to collect an alleged debt. She has been annoyed, inconvenienced and was caused indignation and distress, the suit says, because she has requested that Chase not call her. 

The plaintiff alleges Chase continued to make collection calls even after being requested to desist and engaged in oppressive and/or abusive collection practices.

Wardrup seeks trial by jury, up to $75,000 in damages, costs of litigation, attorney fees and all other relief the court deems proper. She is represented by attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
