Mechanic accuses aluminum plant, foreman of age discrimination

RIPLEY — A West Columbia mechanic is suing an aluminum plant and a foreman, alleging age discrimination.

David McDaniel filed a lawsuit Sept. 1 in Jackson Circuit Court against Constellium Rolled Products Ravenswood LLC and Marc Chiles of Ravenswood, West Virginia, alleging violation of the West Virginia Human Rights Act.

According to the complaint, despite passing all the interviews and tests administered by defendants in 2012 and in April 2016, McDaniel, 53, was not hired as a mechanic. The suit says a younger applicant, who did not pass the welding test, was hired for the position. 

The plaintiff alleges Chiles discriminated against McDaniel by not hiring him because of his age.

McDaniel seeks trial by jury, compensation for all damages, attorney fees, court costs, pre- and post-judgment interest and all other relief the court deems just and proper. He is represented by attorney Roger L. Lambert of Lambert Law Offices PLLC in Charleston.
