Marshall Co. woman blames seller, lender and loan servicer for flooded land

MOUNDSVILLE — A Marshall County woman is suing a seller, lender and loan servicer, alleging breach of contract for land in a flood zone.

Nancy Geary filed a complaint Sept. 1 in Marshall Circuit Court against Wesbanco Bank Inc., David E. McLaughlin and U.S. Bankcorp Service Providers LLC, alleging failure to to comply with their contractual obligations.

According to the complaint, Geary was damaged for incurring additional fees and expenses associated with the acquisition and maintenance of property at 68-70 Roosevelt Ave., Benwood, that was in a flood zone hazard. The suit says Geary bought the property from McLaughlin for $45,000. 

The plaintiff alleges McLaughlin represented that the property was not a flood zone hazard, that Westbanco negligently determined the land was not in a flood zone and that U.S. Bank required Geary to purchase flood insurance for the property.

Geary seeks trial by jury, compensatory damages, plus interest, attorney fees, court costs and all other relief. She is represented by attorney David L. Delk of Grove, Holmstrand & Delk PLLC in Wheeling.
