On June 24, 2014, Jeanne L. Blevins engaged Dr. Vijaykumar Phade and Phade accepted her as a patient in his general surgery practice and performed a laparoscopic cholecystectomy on her, according to a complaint filed in Mercer Circuit Court.
Blevins claims during the surgery, Phade negligently and carelessly deviated from the acceptable standard of care and skill by transecting the common hepatic duct; performing the surgery at an improper level and location; and placing an excessive number of staples and clips in improper locations, which caused unnecessary tissue damage.
As a direct and proximate cause of the defendant’s negligent departure from accepted standards of general surgery care and skill, Blevins suffered damages, including severe and permanent pain, suffering, disability, inconvenience, disfigurement, anxiety and depression, as well as abdominal infections, sepsis and bile leakage, according to the suit.
Blevins claims she also had to undergo a second extensive surgery on July 27, 2014, which she would not have had to do if Phade had properly conducted the first surgery.
The plaintiff also incurred medical, surgical and hospital bills in the amount of $200,000, according to the suit.
Blevins is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Michael F. Gibson of Gibson, Lefler & Associates.
