Former patient, legal guardian allege health care providers violated state law

PRINCETON — A former patient and legal guardian are suing health care providers, alleging failure to provide medical records.

Danny Barker, through his legal guardian, Diana Barker filed a lawsuit Sept. 1, in Mercer Circuit Court against Amanda Bailey, and Princeton Community Hospital Association Inc., doing business as Mercer Medical Group, alleging they violated the West Virginia Code.

According to the complaint, between Jan. 1, 2014 and Jan. 1, 2016, Danny Barker was treated by defendants. The suit says on Jan. 7, 2016 and Feb. 18, 2016, Barker, through his counsel, requested his medical records from the defendants. 

The plaintiffs allege Bailey and Mercer Medical Group failed to provide medical records from Aug. 8, 2014 to April 6, 2015, and Princeton Community Hospital failed to provide medical records for April 9, 2015 to April 30, 2015.

The Barkers seek trial by jury, judgment for the production of the complete medical records requested, attorney fees, costs of court and all other relief the court deems just and proper. They are represented by attorneys Stephen P. New and Amanda J. Taylor of The Law Office of Stephen P. New in Beckley.
