Slatyfork property owner blames homeowner group for cutting off water supply

MARLINTON — A Slatyfork homeowner is suing a homeowner's association, alleging it wrongly cut off his water supply. 

Derek Entemann filed a lawsuit Sept. 1 in Pocahontas Circuit Court against Snowshoe Overlook Condominium Homeowner's Association Inc., alleging the water supply operator forced the plaintiff to sell his home to the defendant's treasurer, Billy Davis.

According to the complaint, Entemann suffered damages for not receiving water from the well owned and operated by the association. The plaintiff alleges Snowshoe Overlook directed the condominium's maintenance worker to sever the water supply to Entemann's home and trespassed upon his rights to the easement he previously enjoyed.

Entemann seeks trial by jury, an order requiring the defendant to restore water service to the plaintiff's home, a permanent injunction requiring the defendant to maintain water service, attorney fees, court costs and all further relief. He is represented by attorney Laura M. Finch of Marlinton.
