Putnam property owner blames Wayne Co. contractor, employee for destroying drainage pipe

WINFIELD — A Putnam County property owner is suing a Lavalette contractor and an employee, alleging their negligence led to the destruction of the plaintiff's drainage pipe. 

Samuel Roberts filed a lawsuit Sept. 1 in Putnam Circuit Court against Asphalt Contractors & Site Work Inc. and Glen Rowe, alleging the contractor carelessly entrusted its vehicle to Rowe.

According to the complaint, on April 15, Roberts suffered damages to his property when defendants' truck, being driven by Rowe, completely sank into plaintiff's yard and crushed Roberts' drainage pipe. The suit says Roberts must spend more than $10,000 to repair all the damage.

The plaintiff alleges Rowe failed to control his truck and negligently drove it in such a manner that it ran off the public highway and into Roberts' yard.

Roberts seeks trial by jury and judgment of $10,000. He is represented by attorney Stephen P. Swisher of Dunbar.
