Raleigh County motorist alleges State Farm owes money

BECKLEY — A Raleigh County motorist alleges State Farm is guilty of breach of contract.

John Chappell filed a lawsuit Sept. 2, in Raleigh Circuit Court against State Farm Mutual Automobile Insurance Company, alleging violation of the West Virginia Fair Settlement Practice Claims Act.

According to the complaint, on Aug. 1, 2015, Chappell was injured in an accident when he parked his vehicle at the Family Dollar parking lot. The suit says he filed a claim with State Farm under his under-insurance motorist coverage after the defendant waived its subrogation rights for $7,000. Chappell claims for damages were $32,000. 

The plaintiff alleges State Farm breached its contractual obligation under its under-insured motorist coverage and failed to promptly and fairly negotiate a settlement and make a reasonable offer.

Chappell seeks trial by jury, judgment against for not less than $50,000, and any other economic and non-economic damages. He is represented by attorney Michael E. Froble of Beckley.
