Two Wheeling residents accuse driver, employer of causing crash

MOUNDSVILLE — Two Wheeling residents are suing a Pennsylvania company and an Ohio driver, alleging their negligence caused a crash that injured one of the plaintiffs. 

Heather M. Hays and Jeremy A. Littell filed a lawsuit Sept. 9 in Marshall Circuit Court against Essroc Ready Mix Corp. of Nazareth, Pennsylvania, and James Patterson of Jefferson County, Ohio, alleging Essroc failed to properly train Patterson.

According to the complaint, on Aug. 2 in Marshall County, Patterson, employed by Essroc, negligently caused the vehicle he was driving to collide with the vehicle being carefully operated by Hays. The suit says collision caused Hays to suffer injuries that resulted in pain and suffering, mental anguish, loss wages and incurred medical expenses for Littell. 

The plaintiffs allege Patterson failed to maintain a proper lookout, failed to maintain proper control of his vehicle and failed to maintain reasonable distance behind Hays' vehicle.

Hays and Littell seek trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees and court costs, plus any other relief. They are represented by attorneys James G. Bordas and Bryan D. Pasciak of Bordas & Bordas in Wheeling.
