NEW CUMBERLAND — A Hancock County homeowner is suing Wheeling contractors, alleging they intentionally refused to return a deposit.
Robert Kranis filed a lawsuit Sept. 12 in Hancock Circuit Court against Statewide Construction LLC, doing business as Statewide Roofing, Siding, Gutters, Ted Marion, II and Vince Doe, alleging breach of duty of good faith and fair dealing.
According to the complaint, on Nov. 12, 2015, Kranis entered into a contract with the defendants to repair his home and garage for $33,500. The suit says Kranis gave the defendants a deposit of $14,200.
Due to defendants' intention of not doing the work, the lawsuit states, Kranis has and will continue to suffer financial damages. The plaintiff alleges the defendants refused to provide blueprints, failed to substantially perform on the home improvement contract and failed to return his deposit of nearly half the costs of the project.
Kranis seeks trial by jury, compensation for all damages, attorney fees, court costs, pre- and post-judgment interest and all equitable relief. He is represented by attorney James A. Kirby III of Goodwin & Goodwin LLP in Charleston.
