Guardian, former patient allege health care providers failed to provide medical records

LOGAN — A guardian and former patient are suing Logan County health care providers, alleging violation of public policy.

Billy Ray Blankenship, by and through his guardian and conservator, Kimberly Blankenship, filed a lawsuit Sept. 14 in Logan Circuit Court against Dr. Jodi Cisco, University Physicians and Surgeons Inc., doing business as Marshall Surgery-Logan, and Logan General Hospital LLC, doing business as Logan Regional Medical Center, alleging violation of the West Virginia Code.

According to the complaint, between Oct. 1, 2015 -May 4, 2016, Billy Ray Blankenship was treated by defendants. On May 4, the suit says, Blankenship and through his counsel, requested records from Cisco and University Physicians but to no avail. 

The plaintiffs allege Cisco and University Physicians failed to provide medical records for review and have no intention of providing them.

The Blankenships seek trial by jury, producing Blankenship's medical records, attorney fees, court costs and all other relief. They are represented by attorneys Stephen P. New, Stacey L. Fragile and Amanda J. Taylor of Stephen P. New Attorney at Law in Beckley.
