Customer alleges pharmacy's negligence led to fall

CHARLESTON — A Michigan woman is suing a West Virginia pharmacy, alleging the defendant's negligence caused injuries to the plaintiff. 

Carole Brender of Flushing, Michigan, filed a complaint Aug. 30 in Kanawha Circuit Court against Fruth Pharmacy Inc., alleging negligence in that insufficient measures were taken to prevent injuries.

According to the complaint, on July 29, 2015, Brender entered a Fruth Pharmacy, 3504 Winfield Road, Winfield, where she tripped and fell over an empty pallet display. The suit says this fall caused serious injuries to Brender that resulted in medical expenses exceeding $123,383.98. 

The lawsuit states Brender also suffered great pain, loss of enjoyment of life and disabilities. The plaintiff alleges Fruth Pharmacy Inc. failed to examine its premises for unsafe and dangerous condition, failed to correct any unsafe condition and failed to maintain its premises in a safe condition.

Brender seeks trial by jury, judgment for compensatory damages, plus court costs, pre- and post-judgment interest. She is represented by attorney Charles M. Love IV of The Love Law Firm PLLC in Charleston.
