CHARLESTON — A Cabell County couple through their lawyer are suing health care providers, alleging insufficient measures were taken to prevent injuries to the husband.
Charles B. Lusher, as next friend of Thomas C. Breech and Lois Breech, filed a lawsuit in Kanawha Circuit Court against Dr. Cynthia Pinson and Pinson Mobile Medicine Inc., alleging violation of the West Virginia Code.
According to the complaint, on July 3, 2014, when Thomas Breech was admitted to St. Mary's Medical Center, he was diagnosed with to severe dehydration, hypernatremia, hyperkalemia, uncontrolled diabetes and acute kidney injury. The plaintiffs allege the defendants failed to exercise the degree of care, skill and learning required of a prudent health care provider for Thomas Breech.
As a result of this lack of care, the suit says, Breech suffered great pain of mind and body and mental anguish.
The plaintiffs seek trial by jury, damages in an amount adequate to compensate for the plaintiffs' injuries and damages, all court costs expended and pre- and post-judgment interest. They are represented by attorney W. Barry Montgomery of Kalbaugh, Pfund & Messersmith PC in Richmond, Virgnia.
