CHARLESTON — A Kanawha County husband and wife are suing an estate representative and law firm, alleging violation of fiduciary duty.
Toni L. Lentz and Robert Lentz filed a lawsuit Sept. 8 in Kanawha Circuit Court against Nancy K. Griffith, individually and as administrator of the estate of Leoda Griffith, and Dinsmore & Shohl LLP, alleging violation of their fiduciary duty by diminishing the value of the estate of Leoda Griffith.
According to the complaint, Toni Lentz was a beneficiary of the last will and testament of Leoda Griffith. As a result of the defendants' breach of duty, the suit says, the plaintiff has lost the value of her inheritance by the diminished value of the estate and actual loss of money.
The plaintiffs allege Nancy Griffith failed to act reasonably and timely in her capacity as estate administrator, sold off shares of stock for her own personal use and failed to timely and properly close the estate of Leoda Griffith.
Toni and Robert Lentz seek trial by jury, an order for Nancy Griffith to be removed as administrator of the estate of Leoda Griffith. They are represented by attorney Michael E. Froble of Beckley.
