Virginia Meadows homeowners allege multiple entities guilty of poor construction

HUNTINGTON — Virginia Meadows homeowners are suing multiple defendants, alleging poor construction of an entire Putnam County subdivision that resulted in flooding and property damage.

Danny and Sarah Campbell, Joshua and Melissa Powell, Richard and Tana Tolley and all others similarly situated filed a class action complaint Sept. 9 in U.S. District Court for the Southern District of West Virginia Huntington Division against Virginia Meadows LLC, Cornerstone Customs Inc., Old Colony Company, doing business as Old Colony, Realtors, also known as Old Colony, Mercy Built LLC, Jordan Garnes, also known as Drew Garnes, Brad Garnes, Richard Garnes, Linda Garnes, Woodland Designs Inc., Richlin Investments LLC and Jimmy Calhoun, doing business as Calhoun Engineering and Surveying, alleging breach of good faith and fair dealing contract.

According to the complaint, due to the defendants’ poor workmanship of the Virginia Meadows subdivision, the plaintiffs have suffered damages in the form of diminished value of their property, financial harm, stress, duress and mental anguish. 

The plaintiffs allege the defendants negligently failed to train, supervise or otherwise control their employees and subcontractors to ensure that they competently constructed the homes and breached their duty to construct a home as a reasonably prudent builder would.

The suit says the defendants' cheap construction of the Virginia Meadows subdivision resulted in homes that are swampy both in the yards and their foundations.

The plaintiffs seek trial by jury, compensation for all damages, attorney fees and costs and all other relief the court deems just and proper. They are represented by attorneys Benjamin M. Sheridan, Daniel K. Armstrong and Mitchell Lee Klein of Klein & Sheridan LC in Hurricane.
