Nurse practitioner accuses medical care providers of wrongful termination

CHARLESTON — A nurse practitioner is suing Kanawha County medical care providers, alleging retaliation and wrongful termination.

Julia Skaggs Sears filed a lawsuit Sept. 12 in Kanawha Circuit Court against Charleston Area Medical Center Inc. (CAMC), Kelly Medical Services LLC, doing business as Teamhealth Atlantic, and Teamhealth South, alleging breach of their employment contract by unlawfully terminating the plaintiff's employment.

According to the complaint, as a result of Sears' termination, she has suffered lost wages and benefits, emotional distress, embarrassment and other non-pecuniary losses. 

The plaintiff alleges CAMC tortiously interfered with her contractual employment relationship with Teamhealth and terminated her employment after she reported the unsafe condition that CAMC had created in its emergency room in June 2016.

Sears seeks trial by jury, compensatory damages, punitive damages, pre- and post-judgment interest, costs of litigation and all other relief. She is represented by attorneys Lia DiTrapano of DiTrapano Law Firm PC in Charleston, and by L. Tom Price of Tom Price Law PLLC in Charleston.
