Daniels couple accuses health care facility, debt collector of violating phone privacy laws

BECKLEY — A Raleigh County couple is suing a health care facility and a Virginia debt collector, alleging invasion of privacy and violation of telephone harassment statutes.

Emily Farley and Adam Farley of Daniels filed a lawsuit Sept. 12 in Raleigh Circuit Court against the West Virginia School of Osteopathic Medical Clinic Inc., doing business as Robert C. Byrd Clinic, and Creditor Collection Service Inc. in Roanoke, Virginia, alleging violation of the West Virginia Consumer Credit and Protection Act and the West Virginia Computer Crime and Abuse Act.

According to the complaint, the Farleys continued to receive collection calls from the defendants even after they were advised that the alleged debt was discharged in bankruptcy. The suit says the repeated calls caused the plaintiffs to be annoyed, inconvenienced and angered, and brought indignation and distress. 

The plaintiffs allege the defendants attempted to collect the debt by coercion, engaged in unreasonable and abusive collection practices and publicized information related to the Farleys' indebtedness.

The Farleys seek trial by jury, compensation not to exceed $75,000 for actual damages, punitive damages, costs of litigation, attorney fees, court costs and all other relief. They are represented by attorney Paul W. Roop II of Roop Law Office LC in Beckley.
