Ohio County couple blames Wheeling restaurant for husband's injuries

WHEELING — An Ohio County husband and wife are suing a Wheeling restaurant operator, alleging the defendant's negligence led to the husband sustaining injuries in a fall. 

Robert L. Nau and Marlene J. Nau filed a lawsuit Sept. 15 in Ohio Circuit Court against Carolla Ventures Inc., alleging the defendant recklessly breached its duty to exercise reasonable care and caution in the operation and maintenance of its premises.

According to the complaint, on Nov. 22, 2014, Robert Nau had breakfast at Perkins Restaurant & Bakery in Wheeling. While walking toward his vehicle, the suit says, he slipped on an icy surface and fell to the ground, causing him to injure his wrist.

As result of defendant's negligence, the lawsuit states, Nau sustained lost wages, medical expenses, pain and suffering. The plaintiffs allege Carolla Ventures failed to maintain its premises in a reasonably safe condition.

The Naus seeks trial by jury, compensatory damages, attorney fees, court costs and expenses, pre- and post-judgment interest, plus all other equitable relief. They are represented by attorney R. Dean Hartley of Hartley & O'Brien PLLC in Wheeling.
