Fuel company alleges Iaeger business owes $66,000

WELCH — A West Virginia fuel provider is suing an Iaeger food mart, alleging breach of contract in failing to pay more than $66,000.

R.T. Rogers Oil Company filed a lawsuit July 19, in the McDowell Circuit Court against Russell Salyers, doing business as a Salyers Family Mart in Iaeger, West Virginia, alleging the defendant breached its contractual obligations.

According to the complaint, between July 2014 and November 2015, R.T. Rogers Oild provided fuel to Salyers Family Mart on an open account relationship in the amount of $66,398.59. The suit says the R.T. Rogers has made reasonable efforts to collect the sums due from the defendant without success. 

The plaintiff alleges a Salyers Family Mart has failed and refuses to pay the past due invoices.

R.T. Rodgers Oil seeks trial by jury, judgment of $66,398.59, plus interest, court costs and attorney fees and all other relief. It is represented by attorney James B. Sheatsley of Gorman, Sheatsley & Company LC in Beckley.
