Former adjuster alleges Nationwide fired her in retaliation

WHEELING — A former insurance adjuster has filed suit against a major insurance firm and her supervisors for alleged retaliation and wrongful termination. 

Michelle Craig filed a complaint June 10 in Ohio Circuit Court against Nationwide Mutual Insurance Co., Nationwide Insurance Co. of America, Nationwide Insurance, David Gainer and P. Douglas Gray Jr., alleging that the employers failed to conduct business in good faith.

According to the complaint, the plaintiff alleges that in 2000, she began working for the defendants as an adjuster until her termination on June 12, 2014, at which time the plaintiff believes the termination was motivated by gender bias, Family Medical Leave Act issues to care for her disabled father, licensure matters and as a retaliation, as a result of defendants' actions, she has suffered inconvenience, humiliation, lost wages and other economic losses. 

The plaintiff holds Nationwide Mutual Insurance Co., Nationwide Insurance Co. of America, Nationwide Insurance, David Gainer and P. Douglas Gray Jr. responsible because the defendants allegedly treated the plaintiff differently as compared to her male counterparts and terminated the plaintiff as retaliation for employees who were perceived to be complaining of heavy workloads.

The plaintiff requests a trial by jury and seeks judgment in her favor, compensatory damages, interest, attorney's fees, costs and such other relief as the court deems appropriate. She is represented by Nicholas A. Wininsky of Wininsky Law Offices in Pittsburgh, Pennsylvania.
