Trucking company alleges insurer violated state law

LOGAN — A Logan County trucking business is suing an insurer and lessee, alleging breach of contract.

Stollings Trucking Company Inc. filed a lawsuit June 23 in Logan Circuit Court against XL Specialty Insurance Company and Bonnie B. Land Group LLC, alleging XL violated the West Virginia Insurance Commissioner Regulations.

According to the complaint, on Dec. 3, 2015, Stollings Trucking suffered a loss of equipment used by Bonnie B in the operation of a highwall miner. A week later, the suit says, the plaintiff submitted a claim to XL requesting coverage from the incident. 

To date, the lawsuit states, Stollings has not received any payment for this claim amounting to $3,165,000. The plaintiff alleges XL did not provide any information on how to proceed with the claim and avoided paying the full amount of the claim.

Stollings Trucking seeks trial by jury, declaratory judgment according to the agreed upon value of the equipment, compensatory loss of rental value and profits, punitive damages and all other relief.
