MARTINSBURG — A Maryland husband and wife are suing a Pennsylvania modular home manufacturer, alleging breach of contract and breach of warranty in failing to remedy construction deficiencies.
Patrick Turnes and Cynthia Turnes of Finksburg, Maryland, filed a lawsuit June 15 in U.S. District Court for the Northern District of West Virginia Martinsburg Division against Foremost Industries Inc. of Greencastle, Pennsylvania, alleging failure to comply with the sales agreement.
According to the complaint, on Sept. 26, 2015, Patrick Turnes and Cynthia Turnes entered into a sales agreement with Foremost for the construction of a modular home in Slanesville, West Virginia. As a result of defendant's failure to remedy construction deficiencies, the suit says, the plaintiffs have suffered damages of $94,718.21.
The plaintiffs allege Foremost failed to provide the construction materials specified, failed to complete the work and cure deficiencies and completely abandoned the project.
The Turneses seek trial by jury, judgment of $94,718.21, plus interest and court costs. They are represented by attorney Stephen M. Houghton of Dickie, McCamey & Chilcotte LC in Wheeling.
