WHEELING — A couple is suing Lumber Liquidators after they claim it is responsible for causing them injuries and damages.
Lumber Liquidators Inc.; Lumber Liquidators Store #1237; and John Does were all named as defendants in the suit.
Leah J. Ging and Trenton A. Ging purchased flooring on May 24, 2013, from the defendants’ Wheeling store when it knew or should have known that the Chinese-made flooring had higher than legal levels of formaldehyde emissions, according to a complaint filed in Ohio Circuit Court.
The Gings claim the defendants knew that their product was defective and that their foreseeable risks exceeded the benefits associated with their product.
Despite the defendants’ knowledge that the products were defective and not fit for their ordinary purpose, they sold the product to unknowing customers, according to the suit.
The Gings claim the defendant had a duty to not falsely advertise the safety of its product or to be dishonest about the emissions levels of its product and failed to use due care.
The plaintiffs had no way of knowing of the defective, dangerous, hazardous and life-threatening components of the product, but that the defendants had adequate knowledge that the product should not have been sold to the Gings, according to the suit.
The Gings claim they suffered illness, sickness, headaches, abdominal bloating, nasal problems, hoarse voice, breathing complications, sinus and throat irritations and other injuries, some of which are permanent, as a result of the defendant.
The Gings are seeking compensatory and punitive damages. They are being represented by Vincent S. Gurrera of Gurrera Law Offices PLLC.
