Wife blames health care provider for husband's death

CHARLESTON — A widow is suing a medical center, alleging its negligence led to the death of her husband. 

Barbara A. Jones, individually and as executor of the estate of Marshall M. Jones, filed a lawsuit May 13 in Kanawha Circuit Court against Charleston Area Medical Center Inc. alleging the defendant negligently and carelessly deviated from the standard of medical care.

According to the complaint, on Dec. 27, 2014, Marshall Jones was admitted to the Charleston Area Medical Center for pneumonia and septic shock with a high risk of falling. On Jan. 5, 2015, the suit says, he fell from a toilet and struck his head causing him to suffer traumatic hemorrhage that required brain surgery. 

The lawsuit states Jones never recovered from his injuries and died April 10, 2015. The plaintiff alleges Charleston Area Medical Center failed to implement an adequate and effective fall protection system and required its nursing staff to accomplish too many tasks, which prevented them from spending more time with patients necessary to keep them safe.

Barbara Jones seeks trial by jury, judgment in such sums that will adequately compensate the plaintiff, prejudgment and post-judgment interest and all other relief the court deems proper. She is represented by attorneys Tony L. O'Dell and Cheryl A. Fisher of Tiano O'Dell PLLC in Charleston.
