Mother, daughter accuse state agency of deprivation of rights

CHARLESTON — A Mingo County mother and daughter are suing a West Virginia state agency and employees, alleging civil conspiracy.

Stephanie Collier, on behalf of, J.C., a minor child, filed a lawsuit June 30 in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources (DHHR), Carolyn Sansom, Jeannie Curry, Ronald May, Stephanie Lucas-Copley and Tony Webb, alleging violation of the West Virginia law, rules and policies in child abuse to shield themselves from liability.

According to the complaint, the plaintiffs allege the child was removed from her home by the Mingo County CPS and DHHR. The suit says she was subjected to abuse and neglect in the Mingo Circuit Court, causing her to suffer harm and damages. 

The plaintiffs allege the Department of Health and Human Resources negligently failed to manage and monitor its employees' activities in relation to the abuse and neglect in the case case and investigation involving the child.

The Colliers seeks trial by jury, judgment sufficient to compensate the plaintiffs for their emotional distress and other damages,. They are represented by attorney Donnie S. Morgan of Morgan Law in Welch.
