WHEELING — A West Virginia couple is suing a tractor trailer owner and driver, alleging their negligence caused a vehicle crash that injured one of the plaintiffs.
Daniel McFarland and Jamie McFarland filed a lawsuit Sept. 16, in the Ohio Circuit Court against Donald Hopkins and Sugar Creek Cartage Co., alleging Hopkins violated the Motor Vehicle Code and other safety laws of West Virginia.
According to the complaint, on Sept. 18, 2014, Daniel McFarland was driving his Lexus GX7 SUV lawfully on Interstate Highway 70 when Hopkins, working for Sugar Creek Cartage and driving a Freightliner tractor trailer, violently struck the plaintiff's vehicle. The collision, the suit says, caused McFarland permanent injuries and medical expenses.
The lawsuit states McFarland has lost the enjoyment of life and Jamie McFarland has suffered loss of consortium. The plaintiffs allege Hopkins failed to yield right of way, failed to maintain proper lookout and failed to maintain control of his vehicle. The suit says Sugar Creek Cartage negligently entrusted its vehicle to Hopkins who was unfit to operate a tractor trailer.
The McFarlands seek trial by jury, judgment, jointly and severally, for compensatory damages, plus pre- and post-judgment interest and for all other relief. They are represented by attorney Jacob M. Robinson of Robinson Law Offices in Wheeling.
