BECKLEY — A Nicholas County motorist is suing State Farm, alleging breach of contract in failing to provide coverage of the plaintiff.
Rocky Molidor of Craigsville, West Virginia, filed a lawsuit Sept. 16 in Raleigh Circuit Court against State Farm Mutual Automobile Insurance Company, alleging failure to to provide under-insured coverage after a 2014 vehicle crash.
According to the complaint, on Sept. 16, 2014, Molidor suffered injuries in a vehicular crash involving three other vehicles on state Route 16. The suit says Michael Gernhardt failed to stop and crashed into another vehicle, which collided with Molidor's vehicle.
As a result, the lawsuit states, Molidor endured pain and sustained medical expenses of more than $31,605.65. Gernhardt's insurer has settled all claims with the plaintiff. However, Molidor alleges State Farm has denied his claim for an accident caused by an under-insured motorist.
Molidor seeks trial by jury and judgment in an amount justified by the evidence. He is represented by attorney Gerald Hayden of Hayden & Associates LC in Beckley.
