WEST UNION — A West Union husband and wife are suing an oil and gas well operator, alleging intentional infliction of emotional distress, trespass and negligence.
Daniel C. Amos and Heather M. Amos filed a lawsuit Sept. 19 in Doddridge Circuit Court against Antero Resources Corp. of Denver, alleging the defendant recklessly operated and maintained oil and gas wells within the vicinity of of th plaintiffs' properties.
According to the complaint, Daniel Amos and Heather Amos have suffered fear of injury and/or death in the event of a gas explosion, plus discomfort, inconvenience, annoyance and difficulty in sleeping. The suit says they also have suffered and will continue to suffer significant damages to their rights to use and enjoy their property in West Union because of the defendant's actions.
The plaintiffs allege Antero Resources willfully and wantonly contaminated freshwater sources near the plaintiffs' property and the defendant's operation maintenance of the well pads nearby caused excessive noise, lights, emissions odor and heavy equipment and truck traffic.
Daniel and Heather Amos seek trial by jury, actual damages for diminution of value of their properties, punitive damages, attorney fees and costs of action and for all other relief. They are represented by attorneys Rodney C. Windom and Scott A. Windom of Windom Law Offices PC in Harrisville.
