Industrial gas supplier alleges mining, metals company owes $12,000

FAYETTEVILLE — A Pennsylvania industrial gas supplier is suing a West Virginia mining and metals company, alleging failure to pay more than $12,000 for purchased products.

Air Products and Chemicals Inc. of Allentown, Pennsylvania, filed a lawsuit Sept. 19 in Fayette Circuit Court against Mountaineer Manufacturing Inc. of Smithers, West Virginia, alleging failure to comply with their agreement.

According to the complaint, Air Products and Chemicals suffered financial damages for not receiving any payment for the goods it sold and delivered to the defendant for $12,419.17. The plaintiff alleges Mountaineer Manufacturing has never paid any of the amount it owed.

Air Products and Chemicals seeks trial by jury, judgment of $12,419.17, plus interest, all legal costs and any other relief to which it is entitled. It is represented by attorney Jerred P. Roth of Burton Neil & Associates PC in West Chester, Pennsylvania.
