McDowell County couple accuses Toyota of warranty violations

PINEVILLE — A McDowell County couple is suing Toyota, alleging breach of implied and express warranties.

Crystal A. Brewer and Walter E. Brewer of Welch, West Virginia, filed a lawsuit Sept. 20 in Wyoming Circuit Court against Toyota Motor Sales USA Inc., alleging violation of the Consumer Protection/New Motor Vehicle Warranties Act.

According to the complaint, on March 30, 2013, Crystal A. Brewer and Walter E. Brewer purchased a new 2013 Toyota Venza for $38,208. Since the purchase, the suit says, the vehicle developed a serious noise at the front end at 7,000 miles, 10,000 miles and again at 12,000 miles. The car has been returned at least six times to Ramey Motors in Princeton. The suit says the car remains out of conformity, which is likely to cause an accident if the vehicle continues to be driven. 

The plaintiffs allege Toyota Motor Sales USA failed to make the repairs that would allow the vehicle to conform with the warranties.

The Brewers seek trial by jury, revocation of acceptance of the vehicle and the refund of the $38,208 purchase price, damages, out of pocket expenses, attorney fees, court costs and all other relief deemed appropriate. They are represented by attorney David G. Thompson of Pineville.
