Cook accuses West Virgnia Health Department, restaurant of defamation

CHARLESTON — A Calhoun County woman is suing the West Virginia Department of Health and Human Resources and other entities, alleging invasion of privacy and wrongful termination.

Georgie Gaglione of Grantsville filed a lawsuit Sept. 21 in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources, Erica McCumbers, Family Advantage LLC , Robert A. Kuhl, Lisa Cooper and Moms Place Too Inc., alleging breach of special duty of care to a personal medical conditions.

According to the complaint, on Oct. 21, 2015, Gaglione was terminated from employment as a cook at Moms Place Too for allegedly being infected with hepatitis C. The suit says the defendants' false allegations caused Gaglione to suffer embarrassment and damage to her reputation. 

The plaintiff alleges the defendants terminated her employment on the perception that she was infected with hepatitis C, which she did not have.

Gaglione seeks trial by jury, compensation for all damages, injunctive relief, reinstatement, attorney fees and all other appropriate relief. She is represented by attorney Walt T. Auvil of The Employment Law Center PLLC in Parkersburg.
