West Virginia company accuses Nationwide of unfair settlement

LOGAN — A West Virginia company is suing Nationwide Insurance, alleging an unfair settlement practice.

Compliance Monitoring Laboratories Inc. filed a lawsuit Sept. 21 in Logan Circuit Court against Nationwide Property & Casualty Insurance Company, Nationwide Mutual Insurance Company, Nationwide Insurance and Lorraine Lusk, alleging breach of contract, and breach of good faith and fair dealing.

According to the complaint, on Aug. 14, 2014, a 2015 Toyota Tacoma belonging to Compliance Monitoring was involved in an accident that resulted in the vehicle's total loss. The suit says the plaintiff has suffered financial damages for not being able to collect insurance on its claim. 

The plaintiff alleges the defendants denied coverage of the policy, stating that it had not been added to plaintiff's original insurance policy.

Compliance Monitoring Laboratories seeks trial by jury, compensation for all damages, pre- and post judgment interest, attorney fees and litigation costs and all other appropriate relief.
