Practical nurse accuses detention center of wrongful termination

WHEELING — An Ohio practical nurse is suing a Wheeling detention center, alleging discrimination, retaliation and wrongful termination.

Cynthia Flanagan of Shadyside, Ohio, filed a lawsuit Sept. 22 in Ohio Circuit Court against Youth Service Systems Inc., Northern Regional Juvenile Detention Center in Wheeling and Linda Scott, alleging violation of the West Virginia Whistle-Blower Act.

According to the complaint, on April 1, Flanagan was terminated from her employment, which caused her to suffer a loss of valuable employment rights, lost wages and economic benefits. The suit says she also suffered inconvenience, humiliation, emotional distress and impairment of personal reputation. 

The plaintiff alleges the defendants subjected her to discrimination, retaliation and wrongful termination because she made a good faith report of the defendants' wrong-doing in relation to the provision of medical services to inmates.

Flanagan seeks trial by jury, reinstatement to her job, recovery of lost wages and benefits, damages, attorney fees, court costs and all other relief. She is represented by attorneys Patrick S. Cassidy and Timothy F. Cogan of Cassidy, Cogan, Shapell & Voegelin LC in Wheeling.
